Si quelqu'un a sa vidéo acceptée, qu'il n'hésite pas à nous le faire savoir. En effet j'aimerais savoir combien de temps ils mettent pour vérifier les vidéos. C'est quand même étrange de vérifier les vidéos avec un service gratuit. J'espère qu'il ne va pas falloir une semaine pour que la vérification se passe.

Pour la vérification c'est le mode hypothétique qui est utilisé : une formule du type "your content MAY be verified prior to its availabity". Donc oui, ce ne sera pas systématique. Pour les vidéos payantes un délai de traitement plus long est annoncé (pour visionnage, vérification et/ou facturation ?).

Introduction. We may revise the terms of this Agreement by providing the new terms and conditions for You to accept or reject when You next log in to the Program and by sending notice to You at your email of record. The email notice will contain a link to the new terms and conditions, which You may accept or reject within ten (10) days from the date the notice was sent to You.  If You do not accept or reject the new terms within the ten (10) day period, You will be deemed to have accepted and be bound by the new terms.  If You reject the new terms, this Agreement will be terminated and You will no longer be able to participate in the Program.

1.	Program Participation.  Participation in the Program is subject to Google's prior approval and Your continued compliance with the terms of this Agreement.  We reserve the right to refuse participation to any applicant or participant at any time in our sole discretion.    Multiple accounts held by the same individual or entity are subject to immediate termination unless expressly authorized in writing by Google (including by electronic mail).  You are solely responsible for keeping your email address and other contact information updated.

2.   Your Content.  After acceptance of this Agreement, You may designate content for hosting and display to end users by uploading such content directly to Us in accordance with the uploading instructions (the "Uploading Instructions") and by providing additional information about Your content in the form provided in connection with the Uploader (the "Uploading Form").   All content so designated by You and contained within such content, including but not limited to all images, closed captioning, and music, is referred to collectively as  "Authorized Content."

3.  Use of Content.   By accepting this Agreement and uploading Your Authorized Content to Google, you are directing and authorizing Google to, and granting Google a royalty-free, perpetual, non-exclusive right and license to, host, cache, route, transmit, store, copy, distribute, perform, display, reformat, excerpt, analyze, and create algorithms based on the Authorized Content in order to (i) host the Authorized Content on Google's servers, (ii) index the Authorized Content; and (iii) display the Authorized Content, in whole or in part in the territory(ies) designated in the Uploading Instructions, in connection with Google products and services now existing or hereafter developed, including without limitation in products developed for syndication.  This license gives Google the right to copy, excerpt, distribute and display Your Authorized Content via both streaming and progressive downloading technologies, and to display limited excerpts of Your Authorized Content for no fee to the end user. Google reserves the right to display advertisements in connection with any display of Your Authorized Content. Notwithstanding the foregoing, Google is not required to host, index, or display any Authorized Content uploaded, and may remove or refuse to host, index or display any Authorized Content.  Google is not responsible for any loss, theft or damage of any kind to the Authorized Content.

4.	Limitations.  If You have designated a price for Your Authorized Content in the Uploading Form, We will not display Your Authorized Content until You have provided billing information as described in the FAQ.

5.  	Promotional License, Brand Features, Publicity. You hereby grant Google a non-exclusive, world-wide, royalty-free license to use Your name and logo ("Brand Features"), in connection with Your Authorized Content, and to use limited excerpts from Your Authorized Content for advertising or promotional purposes, including without limitation the right to publicly display, perform, reproduce and distribute such excerpts and brand features on the Internet and in presentations, marketing materials, customer lists, financial reports and Web site listings of customers.  If this Agreement is terminated, Google may continue to use such excerpts and Brand Features in printed (versus "online") materials that are in existence as of the date of termination until such materials are depleted or are redesigned, whichever comes first.

6.	Uploader.	You may use the Uploader for the sole purpose of providing Your Authorized Content to Google.  You must immediately notify Us of any known unauthorized use of the Uploader.  You may not use the Uploader for any other reason, including but not limited to (i) selling or otherwise redistributing any aspect of the Uploader, (ii) modifying, adapting, translating, or reverse engineering any portion of the Uploader; (iii) attempting to break security, access, tamper with or use any unauthorized areas of the Uploader; (iv) removing any copyright, trademark or other proprietary rights notices contained in or on the Uploader; (v) attempting to collect or maintain any information about other users of the Uploader or other third parties for unauthorized purposes; (vi) transmitting any viruses, worms, defects, Trojan horses or other malicious code or items of a destructive nature; or (vii) using the Uploader for any unlawful, harassing, abusive, criminal or fraudulent purpose.

7.	Proprietary Rights; Required Notices.  Nothing contained in this Agreement conveys any ownership right to Us in any of the Authorized Content, or other materials provided by You.  You acknowledge that as between You and Google, Google owns all right, title and interest in and to the Program and the Uploader and portions thereof, including without limitation, all intellectual property rights.

8.  	Confidentiality.   You agree not to disclose Google Confidential Information without Our prior written consent.  "Google Confidential Information" includes without limitation: (i) all Google software, technology, programming, technical specifications, materials, guidelines and documentation relating to this Program; (ii) any click-through rates, financial information (including pricing), business information, including operations, planning, marketing interests, products, and any other reporting information (including revenues, if any, paid to You by Google) provided by Google; and (iii) any other information designated in writing by Google as "Confidential" or an equivalent designation or that would otherwise be reasonably considered confidential or proprietary under the circumstances.  It does not include information that has become publicly known through no breach by You or Google, or information that has been (a) independently developed without access to Google Confidential Information, as evidenced in writing; (b) rightfully received by You from a third party without a breach of confidentiality by such third party; or (c) required to be disclosed by law or by a governmental authority.

9.  	Payment.    You may designate a price for playback of Your Authorized Content in the Uploading Form.  In the event We decide in our sole discretion to charge for video playback of any of Your Authorized Content, We will pay to You seventy percent (70%) of the gross revenues, if any, recognized by Google and attributable to such video playback of Your Authorized Content based upon the price you designate. If We incur extraordinary costs and expenses in hosting, indexing and displaying Your Authorized Content relative to its designated price, then We may retain a greater percentage of the revenues in order to defray these costs.  If You have not designated a price for Your Authorized Content and We incur extraordinary costs and expenses in hosting, indexing and displaying Your Authorized Content, we may charge a fee in order to defray these costs.

10.  	Disclaimer and Limitation of Liability.  THE PROGRAM AND THE UPLOADER ARE PROVIDED "AS IS" WITH NO WARRANTIES WHATSOEVER.  GOOGLE EXPRESSLY DISCLAIMS ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, AND PERFORMANCE OF THE PROGRAM AND THE UPLOADER AND THE WARRANTIES OR CONDITIONS OF NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE.  EXCEPT FOR ANY PAYMENT OBLIGATIONS SET FORTH IN SECTION 9, IN NO EVENT SHALL GOOGLE BE LIABLE UNDER THIS AGREEMENT FOR ANY DIRECT, CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY OR PUNITIVE DAMAGES, WHETHER IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

YOU UNDERSTAND AND AGREE THAT YOU USE THE PROGRAM AND THE UPLOADER AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR YOUR AUTHORIZED CONTENT, AND FOR ANY DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF THE UPLOADER.

11.	You Must Have the Right to Use All of the Images, Music and Data of Any Sort in Your Authorized Content, and You Must Have the Right to Grant the Licenses in this Agreement. By accepting this Agreement and uploading Your Authorized Content, You represent and warrant to Google the following: (a) You are at least 18 years of age, (b) all of the information provided by You to Google to enroll and participate in the Program is correct and current (including without limitation information You provide in the Uploading Form); (c) the Authorized Content is not, in whole or in part, pornographic or obscene (d) You hold and will continue to hold the necessary rights, including but not limited to all copyrights, trademark rights and rights of publicity in and to Your Authorized Content and Your Brand Features to enter into this Agreement and to grant the rights granted herein; (e) You have the legal right and authority to enter into this Agreement, to perform the acts required of You under the Agreement, and to grant the rights and licenses described in this Agreement.  You further represent and warrant that the Authorized Content and the rights and licenses granted to Google under this Agreement (including the public display, public performance, distribution and reproduction of Your Authorized Content): (i) do not and will not violate any applicable law, statute, ordinance or regulation and (ii) do not breach and will not breach any duty toward or rights of any person or entity including, without limitation, rights of intellectual property, publicity or privacy, or rights or duties under consumer protection, product liability, tort or contract theories.

12. Your Obligation to Indemnify.    You agree to indemnify, defend and hold Google and its respective directors, officers, employees, and applicable third parties (e.g. relevant advertisers, syndication partners, licensors, licensees, consultants and contractors) (collectively "Indemnified Person(s)") harmless from and against any and all third party claims, liability, loss and expense (including reasonable legal fees, damage awards, and settlement amounts) brought against any Indemnified Person(s) arising out of, or related to or which may arise from Your Authorized Content, Your Brand Features, Your use of the Program and the Uploader, and/or Your breach of any term of this Agreement.  Google may join in defense with counsel of its choice at its own expense.

13.  Termination; Withdrawal of Content.   Either party may terminate this Agreement immediately upon written notice to the other party if the other party files a petition for bankruptcy, becomes insolvent, or makes an assignment for the benefit of its creditors, or a receiver is appointed for the other party or its business.  You may terminate this Agreement for convenience upon thirty (30) days prior written notice. You may withdraw Your Authorized Content from public display in the Program by providing Google with a written request as set forth in the FAQ.  Google will use commercially reasonable efforts to remove Your Authorized Content from public display within thirty (30) days from receipt of notice of termination or withdrawal.   Google may at any time in its sole discretion terminate the Program, terminate this Agreement, or withdraw any Authorized Content in the Program.

14.	Privacy and Information Rights.  You agree that We may use information that You provide to Us when You register for the Program (including but not limited to contact and billing information) in accordance with the privacy policy located at http://www.google.com/privacy.html.  In addition, You agree that Google may transfer and disclose this information, including personally identifiable information, to third parties for the purpose of approving and enabling your participation in the Program, including to third parties that reside in jurisdictions with less restrictive data laws than Your own.  Google may also provide information in response to valid legal processes, such as subpoenas, search warrants and court orders, or to establish or exercise its legal rights or defend against legal claims.  Google disclaims all responsibility, and will not be liable to You, however, for any disclosure of that information by any such third party.

15.  General.

	a.  Notices.  Unless provided for to the contrary in this Agreement, any and all notices or other communications or deliveries required or permitted to be made under this Agreement shall be sent (a) if to You at the electronic mail address You provide in registering for the Program and (b) if to Google to such address as provided at www.google.com/corporate/address.html or as otherwise provided in writing for such notice purposes. A second copy of every notice to Google shall be sent to the same address, "Attn: Legal Dept."  Notice shall be deemed received (i) upon receipt when delivered personally, (ii) upon written verification of receipt from overnight courier, (iii) upon verification of receipt of registered or certified mail (iv) upon verification of receipt via facsimile, provided that such notice is also sent simultaneously via first class mail, or (v) by electronic mail when sent by Google only.  Contact information shall be updated as necessary to ensure that each party has current information regarding all such contacts.

	b.  Miscellaneous.  You may not resell, assign or transfer any of Your rights hereunder.  Any such attempt shall be null and void.  The relationship between Google and You is not one of a legal partnership relationship, but is one of independent contractors.  The words "You" or "Your" shall also mean heirs, executors, administrators, successors, legal representatives and permitted assigns. This Agreement does not affect any right that either party would have had, or shall have, independent of the Agreement including rights relating to Authorized Content under applicable law, including but not limited to copyright law.  Neither party shall be liable for failing or delaying performance of its obligations resulting from any condition beyond its reasonable control, including but not limited to, governmental action, acts of terrorism, earthquake, fire, flood or other acts of God, labor conditions, power failures, and  Internet or other network disturbances.  If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and remain enforceable between the parties.  The failure of either party to act in the event of a breach of this Agreement by the other shall not be deemed a waiver of such breach or a waiver of future breaches.  This Agreement sets forth the entire understanding and agreement between the parties with respect to the subject matter hereof.   This Agreement shall be governed by the laws of the State of California, without regard to its principles of conflicts of law.  Any litigation hereunder shall be brought in any state or federal court of competent jurisdiction in Santa Clara County, California; the parties agree that venue shall be proper in, and consent to the personal jurisdiction of, such courts.  The parties specifically exclude from application to the Agreement the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act.  The provisions of Sections 5, 6, 7, 8, 10, 12, 14, and 15 shall survive any expiration or termination of this Agreement.

Program Overview

   1. What is Google Video?

      Our mission is to organize the world's information and make it universally accessible and useful. Currently, Google Video lets you search a growing archive of televised content -- everything from sports events to dinosaur documentaries to news programs. In addition to televised content, we're now accepting video from anyone who wants to upload content to us. Uploaded content will not be immediately available to users searching Google Video as this is just the submission stage of the program. But (if you'll pardon the pun) stay tuned.

   2. What is the Google Video upload program?

      The upload program lets you submit videos electronically to Google Video, as long as you own the necessary rights (including copyrights, trademarks, rights of publicity, and any other relevant rights for your content). Just sign up for an account and use our upload tool to send your videos to Google. The program is still in beta so you won't see your videos live on Google Video immediately.

      To make sure that your video is submitted properly, please read below about preferred file formats and our approval process. Videos may not go live if they're not approved or if we're unable to accept the format.

   3. When will my videos be on Google Video?

      We're still in the first phase of the upload program. Once we approve your video submission and enter the next phase, we'll send you an email (to the email address you provide) to let you know that we're ready to add your content to Google Video. Users will then be able to search, preview, purchase, and play your video.

      At any time after you upload your video to Google, you'll have the opportunity to add more videos, update the information about each video, or remove your video from the program. The content may be reviewed by Google prior to being made available online. You can rest assured, however, that we'll notify you if we cannot use the content you submit

   4. What types of videos are you accepting?

      We accept any type of video content, with these restrictions:
          * You must own all necessary rights to the content, including copyrights toboth the video and the audio.
          * You must be able to upload the video to us electronically.
          * The video must not contain pornographic or obscene material.

      The content may be reviewed prior to being made available online. If we cannot use it, we'll let you know.

   5. Will users be able to play my videos?

      At this time, we're only collecting videos for potential inclusion in the program. When we enter the next phase, users will be able to search, preview, purchase, and play your video – depending on your preferences. In order to promote your video to users, every video on Google Video will allow users to see a quick preview. When we're ready to distribute your video on Google Video, we'll notify you.

      If you assign a price to your video or submit a video in an undesirable file format, it may take longer for your video to be included on Google Video. In some cases, we may not be able to publish your video on Google Video if it's in a different format. Please review our preferred file formats

      You can keep up to date on the status of the program by visiting the Google Video Upload page. From this page, you can sign in to your account to keep track of your video status.

   6. What will Google do with my video?

      After you submit your video to Google Video, we may review it as a part of our approval process. When we're ready to move to the next phase of the program and begin including your videos in Google Video, we'll notify you (at the email address you provide).

      At any time, you have the opportunity to add more videos, update the information about each video, or remove your video from the program Please note that each time you update your information, it may be re-reviewed, which could delay the time it's published.

   7. Can I charge for playback of my video?

      Yes. Or you can allow users to play your video for free. This is totally up to you and your video distribution goals. As the content owner, you decide whether you'd like to give away your video for free or charge a price that you set for it. If you do charge a price, Google will take a small revenue share to cover some of our costs.

   8. How is my content protected?

      Google takes the security of your content very seriously. We've put a number of measures in place to prevent copying or sharing of your content. For more information on our copyright policies and procedures, please read the Copyright section of this FAQ.


Uploading Videos

   1. How do I apply?

      Simply sign up for the Google Video program. Then, download the Video Uploader tool, and follow the instructions for uploading your content to Google Video. Before uploading any video, you must read and agree to the Google Video Upload Program Terms and Conditions.

      We can't guarantee that all videos will be included in Google Video. The content may be reviewed prior to being made available online. Please be assured that we'll notify you if we cannot use the content you submit

   2. Will users be able to click through to my website?

      Yes. You can add your URL and other information to your video via your Video Status page in your account. Once your video is available on Google Video, users will be able to click your URL to visit your website. We realize that traffic to your website is valuable and hope to generate even more for you through this program.

   3. Does my video need captions or a transcript?

      The more information you provide to us, the better your video can be searched. While we don't require that you add captions or a transcript to your video, we strongly recommend it.

      To add a transcript and additional video information, visit your Video Status page, and click “Add” beneath the Transcript column. For formatting tips, visit our Submitting Transcripts page.

   4. Can I add information to my video to help people find it?

      Yes. Each time you submit a video, you'll be asked to add information about your video with as much related information as you can provide (Geeks call this metadata). This will help users find your videos. The more information you provide, the better your video can be searched.

   5. What file formats do you accept?

      Google accepts video in a wide range of popular formats. The fastest way to get your videos into Google Video is to submit each file in MPEG4 format with MP3 audio or MPEG2 with MP3.

      While we also support other digital formats such as QuickTime, Windows Media, and RealVideo, it's important to note that submitting your files in these formats may significantly delay us from using them on Google Video. In some cases, we may not be able to add your video at all.

      Here are our preferred video specs:
      NTSC (4:3) size and framerate, deinterlaced
      Video Codec: MPEG2 or MPEG4 (MPEG4 preferred)
      Video Bitrate: at least 260Kbps (750kbps preferred)
      Audio Codec: MP3 vbr
      Audio Bitrate: at least 70Kbps (128 Kbps preferred)

   6. What are the system requirements for the Google Video Uploader? Is there a size limitation? A maximum number of videos I can upload?

      You can upload as many videos to Google Video as you like, without any size or length limitations. However, we do require the following:
          * You must be operating on Windows 98 or higher to install the Uploader.
          * You'll need a broadband connection to upload video.

   7. All my videos are on physical media such as VHS, Beta or DVD. Can I mail you my videos?

      Not at this time. Currently, we can only accept content uploaded electronically.

   8. Can I remove my videos after I upload them?

      Yes. Please let our support team know and we'll remove your content from the program.

   9. How do I choose a price for my video?

      You can name any price for your video, which can be done from your Add/Edit Video Information page. The price you choose completely depends on you and your distribution goals.

      We suggest that you choose a fair price that you think users will pay to view your video content. Because you can change the price at any time, experiment and see what price brings you the most success.

      You can also set the price to zero and allow users to access and play your video for free. This will potentially give you wider distribution than those who choose to charge a price.

  10. What does Google do with the personal information I submit when I create an account?

      In order to upload video, you'll have to provide some unique information such as your name and email address. @Mertyl : oui j'ai aussi eu un loupé et tu peux le reprendre à "l'endroit" de la coupure. Ds mon cas c'est du à ma connexion Cegetel moisie je suppose.

si ça met les freebox a genoux, google va garder encore longtemps le surnom de dieu , et pour d'autres raisons
J'ai pas encore tester le download mais pour l'upload j'étais a 32ko/s fixe avec une adsl 650kb/s en up (80ko/s)

Idem. J'ai uploadé une vidéo il y a déjà plusieurs jours et toujours aucunes nouvelles...
